El Tribunal Supremo de India se negó a permitir el matrimonio entre personas del mismo sexo. El tribunal dijo que el parlamento debía decidir al respecto.
Se mostraron de acuerdo con el gobierno y su opinión de que el parlamento debe ocuparse de esta cuestión. La decisión decepcionó a la comunidad LGBTQ de India. Hace cinco años, el tribunal eliminó una ley contra las relaciones homosexuales de la época colonial. El partido gobernante, el BJP, afirmó que el matrimonio entre personas del mismo sexo no encaja en la estructura familiar tradicional india. El fallo del tribunal se produjo tras muchas peticiones en el último año. El presidente del Tribunal Supremo, D.Y. Chandrachud, dijo que la labor del tribunal es interpretar la ley, no crearla. Tampoco estuvo de acuerdo con la opinión del gobierno de que ser homosexual es cosa moderna de gente rica y que vive en ciudades.
